The constitutional complaint


Definition:

Democratic remedy to protect the rights and freedoms provided for in the Polish law, which gives citizens the opportunity to challenge the acts violating the rights contained in the Constitution.



The right to file a constitutional complaint is available to anyone whose constitutional freedoms or rights have been violated. A constitutional complaint can only challenge a provision of a law or other normative act, based on which a court or public administration body has made a final ruling on the specific freedoms, rights or obligations of the complainant, as specified in the Constitution.
